Terms of Service
1. Binding Agreement & Service Overview
These Terms of Service (the "Terms") constitute a legally binding agreement between your brokerage or agency entity ("Broker," "Customer," "you") and Aptura LLC ("Aptura," "we," "us," or "our").
By accessing or utilizing the MyBrokerTeam platform, website (apturahealth.com), applications, API endpoints, or associated services (collectively, the "Service"), you agree to be bound by these Terms.
2. Nature of Software: Pure Technology Provider
Aptura LLC is a software technology vendor, not an insurance agency or insurance brokerage.
- Aptura LLC does not sell, solicit, negotiate, or bind insurance policies.
- Aptura LLC is not appointed by insurance carriers and does not receive insurance commissions, per-member-per-month (PMPM) splits, or carrier overrides.
- You, as the licensed broker or designated agency principal, retain full legal and professional responsibility for all plan recommendations, quoting accuracy, client suitability determinations, and policy submissions.
3. Broker Ownership of Client Data & Book of Business
You retain all right, title, and ownership interest in all client data, applicant records, contact lists, and transaction histories ("Broker Data") uploaded to or processed by MyBrokerTeam.
- Aptura LLC will never sell, lease, or monetize Broker Data to third-party marketing entities or competing agencies.
- Aptura LLC will never use Broker Data to market competing products or services to your clients.
- You may export your complete database in standard formats (CSV, JSON) at any time.
4. AI Assistance & Licensed Authority
MyBrokerTeam features AI-driven data extraction and workflow automations designed to assist licensed brokers in quoting and administrative follow-up.
All AI outputs (including extracted household data, subsidy calculations, and plan comparisons) are provided as administrative drafts for broker review. The licensed broker is solely responsible for confirming plan accuracy and carrier appointment requirements before presenting proposals to applicants or binding policies through carrier portals or CMS direct enrollment systems.
5. Compliance with CMS & Healthcare Regulations
Brokers using the Service represent and warrant that they maintain all necessary state licenses, National Producer Numbers (NPNs), and carrier appointments. Brokers agree to utilize the platform in compliance with Centers for Medicare & Medicaid Services (CMS) regulations, including obtaining and documenting consumer consent for representation prior to quoting or enrolling individuals in marketplace health plans.
6. Subscription, Fees & Cancellation
MyBrokerTeam is billed as a recurring software subscription. Aptura LLC does not take any percentage of your insurance commission revenue. You may cancel your subscription at any time upon thirty (30) days written notice.
